Please read these terms before using the website or the client portal.

1. Agreement

These Terms of Use govern your use of www.medfilesnow.com and the MedFilesNow client portal, offered by Wolf Bridge, Inc., a Nevada corporation registered in Florida as a foreign corporation, doing business as MedFilesNow (“MedFilesNow,” “we”). Records retrieval itself is provided under a separate client service agreement and Business Associate Agreement signed in the portal. If those agreements conflict with these Terms, they control.

2. Eligibility

Accounts are available only to law firms and insurance companies, and their authorized personnel, acting for a lawful business purpose. The person who opens an account confirms they are authorized to bind the organization. We may decline or close any account.

3. Account security

• Each user must have an individual login. Sharing logins is not permitted.
• Multi-factor sign-in is required. Keep credentials and devices secure.
• The account administrator is responsible for adding and removing users promptly.
• Tell us right away at Info@MedFilesNow.com if you suspect unauthorized access.

4. Authorizations and requests

You are responsible for submitting a valid authorization or other lawful basis for every request, and for using records only as that authorization and the law permit. Law firms may submit requests for a legal claim or a broad “At my request” pull authorized by the patient. Insurers may submit requests for underwriting, for all lines of insurance. Requests stay on hold until the authorization passes review.

4a. Records

Delivered records are available to download in the portal for 30 days after delivery, then deleted. Download and keep delivered records under your own retention policies. Authorizations, audit logs, and billing records are kept for 6 years.

5. Acceptable use

You will not:

• request records without a lawful basis, or misrepresent your identity or purpose;
• access another organization’s data, or test, probe, or bypass security controls;
• upload malicious code or interfere with the service;
• resell or redistribute the service or records except as your authorization and the law allow;
• send patient information by email to MedFilesNow.

6. Fees

Fees are per patient pull as published on the website or quoted in writing, and are payable under your client service agreement. Prepaid plans let you purchase an allotment of pulls for current or future files. Prepaid fees are earned when the allotment is set up; when you use the pulls is up to you. Prepaid balances are not held in escrow or trust. Prepaid pulls never expire and are non-refundable. A pull is fulfilled when at least one record is delivered; if a pull returns no records for the patient, that pull is credited to your prepaid balance (not a cash refund). Other payment terms are governed by the service agreement.

7. Timing and results

MedFilesNow obtains records by searching an electronic health-information network; it does not contact providers. Records are typically expected within about 72 hours to one week. That is an estimate, not a guarantee, and MedFilesNow does not guarantee a turnaround time. Rush is a faster estimate for an additional fee, quoted by Sales; the pull starts as Rush only after you accept the quote, and starts as Standard if you decline or do not respond within 1 business day. Once a pull starts it cannot be cancelled. MedFilesNow does not guarantee that any particular record, provider, or date of service will be returned. Providers who keep paper charts are not reached, and radiology image files are not delivered.

8. Disclaimers

Except as stated in your service agreement, the website and portal are provided “as is” and “as available.” We do not give legal, medical, or underwriting advice. Retrieved records are copies of electronic records as returned by the network, and we do not warrant their completeness or accuracy. The Recap is a summary of those records, not a medical opinion or diagnosis.

9. Limitation of liability

10. Suspension and termination

We may suspend access to protect the service, patients, or other clients, or for breach of these Terms. Termination does not affect obligations that by their nature survive, including confidentiality and payment.

11. Governing law
